Terms of Service

Please read these Terms and Conditions carefully before using our website or purchasing a class and/or membership. We recommend that you print a copy of these for future reference.

By placing an order with us for products or services, or using our website, you confirm that you accept these Terms and Conditions and that you agree to comply with them. If you do not agree to these Terms and Conditions, you must not proceed with placing an order or using our website in any way.

Who we are and how to contact us

TheMovementProject.co.uk is owned and operated by The Movement Project Cornwall Limited (“TMP”, “we”, “us”, “our”). We are registered in England and Wales under company number 14263945 and have our registered office at 11a Kimberley Park Road, Falmouth, England, TR11 2DA .

We are a limited company.

How we will contact you

If we need to contact you we will do so using the contact details you provide to us.

By giving us your contact details you also give us your consent to contact you about the service we provide and any product you have bought or enquired about. If necessary, we may leave you a message.

It is the customer’s responsibility to ensure that its contact details are kept up to date.

These Terms and Conditions refer to the following additional terms, which also apply to your use of our website, products and services:

General conditions of use

Below are the general conditions of use of our gym site and its equipment, whether inside or outside the facility:

Each type of class will have its own specific rules of conduct to ensure your safety and ours. Our interpretation of the rules and these terms will take precedence over yours.

We reserve the right to refuse admission or request you leave the premises for such actions relating to failure to observe the rules and conditions or for health and safety concerns. If you are excluded, your membership and class bookings will be terminated. You will not receive a refund of any Fees paid for or in connection with your membership.

You are not permitted to enter the TMP facility or partake in activities when under the influence of alcohol or illegal or recreational drugs.

You are not permitted to smoke, vape or use e-cigarettes anywhere on the premises or in the immediate vicinity of the TMP site.

From time to time, we may need to change, cancel, postpone, or introduce new classes or services for any reason, including in response to customer feedback. We may also need to decommission equipment and/or areas of the facility for any reason including but not limited to maintenance, repair and alteration. We will, where reasonably possible, display notices on site or contact you by email in advance to advise you of such a change.

If you are unsure about how to use any of the equipment in the facility, you must request instruction from a member of staff on site.

We do not take responsibility for your health, wellbeing, and fitness level. Exercise carries its own risk and you should never exercise beyond your capability. Should you have doubts as to your fitness capability, or you have any medical conditions that may affect your safety through exercise, you should seek advice from your doctor before undertaking the activity.

Upon joining as a member or attending a class, you agree to the following statement concerning your health:

I choose to be included in guided physical activity and confirm that I do not have any health conditions which may prevent or adversely affect my participation in the exercises. If my health status changes, I will seek guidance and clearance to exercise from my GP or other relevant health professional before participating any further in the physical activity.

Management may allow you to take photos or videos but any formal or more extensive filming or photography must be approved beforehand in writing. TMP staff have absolute discretion in deciding whether such recording activities are appropriate and/or permitted.

Our Memberships

Memberships currently include access to unlimited classes and use of the TMP facility during its opening hours.

Memberships can be purchased at any time online and the payments are prorated with the full payment due on the 1st of each month. For example, if you purchased membership (costing £65 per month) on the 20th April, your first payment would be for £23.87, and the first full payment due on the 1st May would be for £65.

You should ensure that your membership details are kept up to date using your online account. You can access your information via the website or request them from a member of the TMP staff. Membership details include your bank account information. It is important these are kept up to date otherwise it may impact your membership.

Memberships can be purchased online, and in some cases in person, and paid for using a bank account Direct Debit mandate or with a debit or credit card. See Pricing and how to pay section.

Memberships cannot be transferred to another person.

Class Bookings & Cancellations

To ensure fair access to classes and the best experience for all TMP members:

Memberships (Unlimited / Recurring Members)

  • A minimum of 12 hours’ notice is required to cancel a class
  • Late cancellations (under 12 hours) or non-attendance may result in a no-show being recorded

Class Bundles (Pay-As-You-Go / Credit Packs)

  • A minimum of 24 hours’ notice is required to cancel a class
  • Cancellations made with more than 24 hours’ notice:
    • Your class credit will be returned for future use
  • Cancellations made within 24 hours:
    • The class credit will be forfeited and is non-refundable

All classes for all members must be booked in advance via our TeamUp booking system. Bookings are not transferable between customers.

You must book each class via our online class booking system. Changes and cancellations must take place on the booking system too.

No-Show Policy

If you do not attend a booked class and fail to cancel in advance, this will be recorded as a no-show.

  • If you accumulate 3 no-shows for a class, you will be:
    • Temporarily removed from booking that specific class
    • For a period of 7 days

This helps ensure spaces are available for members who are ready to train.

Membership Freezes (For Members Only)

We understand that life happens – whether it’s travel, injury, or other commitments.

To support this, we offer the option to pause your membership:

  • Memberships can be frozen for up to 6 weeks per calendar year
  • A maximum of 2 freeze requests per year
  • A minimum of 7 days’ written notice is required
  • Freeze requests must be emailed to hello@themovementproject.co.uk
  • Freezes begin from your next billing date
  • During a freeze period, a reduced £5/month holding fee applies

We’ll always aim to support genuine circumstances while encouraging consistency in your training.

Membership Cancellations

We’re committed to helping you get the most from your membership, but understand circumstances can change.

  • Memberships require a minimum of 30 days’ written notice to cancel
  • Cancelation notice must be emailed to hello@themovementproject.co.uk
  • Your membership will remain active until the end of your current billing period and notice period
  • No partial refunds are issued for unused time

If you’re thinking of cancelling, we encourage you to speak with a coach first – we may be able to support you with a plan, adjustment, or temporary pause instead.

Class Bundles (Credits)

  • Class bundle purchases are valid for 3-9 months from the date of purchase
  • Credits are:
    • Non-refundable
    • Non-transferable
  • Missed classes or late cancellations will result in the loss of the class credit
  • If a class is cancelled by us, any affected bookings will:
    • Be credited back to your account
    • Available for use within your bundle validity period

We reserve the right to amend future bundle offers; this will not affect existing purchases.

Our Approach

  • Maintain a positive training environment for all members

Clubs

TMP offers specific time slots during the week for local sports, fitness, and activity clubs to have exclusive use of the facility. Please enquire for available slots by emailing hello@themovementproject.co.uk.

Under 16s

TMP offers exercise programmes and services to adolescents under 16 and is subject to a consenting adult being present during the duration of the session with any of our trainers. The terms and conditions outlined in these Terms of Service apply to both the adolescent and guardian.

How a contract is formed between you and us

Our website will guide you through the steps you need to take to join classes and/or join as a member. Alternatively, orders may be placed via telephone or email, if necessary.

Payment must be received in full in cleared funds before we grant attendance to a class or agree to membership of TMP. Once we receive payment, we will confirm our acceptance to you by sending you a confirmation email (“Order Confirmation”). The contract between us will only be formed on the date we send you the Order Confirmation (the “Contract”).

We use TeamUp, a third party gym management software company, to manage online administrative tasks and take payments. You will need to read their own terms of service at the point of booking a class or purchasing services from us. See goteamup.com for more details.

Pricing and how to pay

The price of the Classes and Memberships will be as quoted on our website at the time you submit your order. Prices for our Classes and Memberships may change from time to time.

You may pay for classes and memberships using a debit or credit card (including Visa, MasterCard, American Express, Visa Electron, Switch, Solo, Maestro or JCB), or in some cases by bank transfer.

Memberships can be paid for using a Direct Debit mandate, set up at the point of purchase online. TMP utilises the high security payment platform, GoCardless, for Direct Debit set-up and debit / credit card payments.

TMP does not hold payment details. These are stored securely by TeamUp and GoCardless.

We may make changes to these terms

We amend these Terms and Conditions from time to time and you should check them from time to time so you can be happy with any changes that are relevant to you.

We may make changes to our website

We may update and change our website from time to time to reflect changes to our service and our users’ needs.

How you may use material on our website

We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our website for your personal use and you may draw the attention of others within your organisation to content posted on our website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our website must always be acknowledged.

You must not use any part of the content on our website for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our website in breach of these Terms and Conditions, your right to use our website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Do not rely on information on this website

The content on our website is provided for general information only. It is not intended to amount to health and wellbeing advice on which you should rely.

Although we make reasonable efforts to update the information on our website or provided, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or up to date.

We are not responsible for websites we link to

Where our website contains links to other websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those websites or resources.

Our responsibility for loss or damage suffered by you

The Classes and/or Membership you purchase from us are for private use only. We are not liable to you for any loss of profit, loss of business or revenue, business interruption or loss of business opportunity.

Our total liability to you resulting from a Contract is limited to the total value of that Contract – meaning the price you paid for the Classes and/or Membership. In particular we are not liable for any costs, loss, delay, inconvenience or damage you suffer as a result of:

  • any injury you may suffer from carrying out any of exercise or physical activity recommended by us;
  • your failure to act upon our advice if we recommend that you seek medical advice or attention having taken attended the gym at the TMP site;
  • your failure to consult your GP or doctor about your general health and partaking in guided exercise.

If we fail to comply with the Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the Terms and Conditions or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this Contract.

It is your responsibility to ensure that the relevant sample has been collected and sent to our laboratory within the Validity Period.

We do not in any way exclude or limit our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any breach of the Consumer’s statutory rights.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by any act or event beyond our reasonable control (an “Event Outside Our Control”).

If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:

  • we will contact you as soon as reasonably possible to notify you; and
  • our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days.

How we may use your personal information

We will only use your personal information as set out in our Privacy Policy.

Car Parking

Car parking facilities are available on site but are limited. You may use such spaces only when attending our site. We accept no liability for any loss or damage which may result from using the car parking facilities.

Rules about linking to our website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to our website in any website that is not owned by you.

Our website must not be framed on any other website, nor may you create a link to any part of our website other than the home page.

We reserve the right to withdraw linking permission without notice.

Which country’s laws apply to any disputes

These Terms and Conditions, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
